Article 1: General Global Terms

1.1 Nature and Limitations of AI-Generated Content

Non-Professional Advice: Outputs generated by the Artificial Intelligence (AI) models used in the Service (including, but not limited to, text, images, code, suggestions, or analysis) are provided solely for general reference and informational assistance. The Service does not constitute formal or complete professional advice in any field (including, but not limited to, medical, diagnostic, legal, financial, investment, accounting, or engineering professions). You should seek independent advice from qualified professionals before taking any action based on such content.

AI Hallucinations and Accuracy Disclaimer: AI technology inherently possesses uncertainties and may generate inaccurate, incomplete, misleading, or outdated information (i.e., "AI hallucinations"). The Company does not guarantee the accuracy, completeness, timeliness, or fitness for a particular purpose of the generated content.

Content Review Responsibility: Due to the limitations of AI-generated content, you shall independently evaluate and assume all risks associated with using such content. The Company assumes no liability for any direct or indirect losses or additional costs incurred from your adoption of AI-generated content.

1.2 Intellectual Property Rights and Ownership

Input Content (Prompts): You retain the original intellectual property rights in the text, images, and other materials you upload or input into the Service ("Input Content") and warrant that you hold full legal rights to such Input Content without infringing upon any third party's intellectual property, trade secrets, privacy, or other legal rights, nor violating any applicable laws.

Output Content (Outputs): To the maximum extent permitted by law, the Company licenses the rights in the AI-generated output content to you for lawful purposes. However, you understand and agree that the AI model operates based on statistical probability; the Company does not warrant that Output Content is copyrightable in any jurisdiction (e.g., whether it possesses human authorship), nor does it guarantee that Output Content will not be identical or similar to existing or third-party creations. The Company makes no express or implied warranties regarding originality, legality, or non-infringement of third-party intellectual property rights. You must conduct appropriate legal and rights clearances before commercializing or publicly disseminating Output Content.

Indemnification: If your violation of these Terms, infringement of third-party rights, or Input Content and usage behavior causes the Company, its affiliates, or employees to face any third-party investigations, claims, lawsuits, or demands, you shall defend the Company at your own expense and indemnify the Company against all resulting damages and expenses (including, but not limited to, reasonable court costs, litigation fees, arbitration fees, and attorney fees).

Third-Party Copyright Disclaimer: AI models are trained and generate outputs based on massive datasets. The Company does not guarantee that Output Content will not be identical or similar to existing protected third-party works. When using Output Content for commercial or public purposes, you shall independently assess overlap and infringement risks. If third parties claim copyright, trademark, or trade secret infringement arising from your use of Output Content, you shall bear all legal responsibilities, and the Company assumes no liability.

Notice and Takedown Procedure: The Company respects intellectual property rights. If a copyright owner or their agent believes that any content within the Service (including user inputs or AI outputs) infringes their copyright, please send an email with evidence of infringement and contact information to our service inbox. Upon confirmation, the Company will promptly take appropriate measures, such as takedown, blocking, or disabling links.

1.4 Service Modification and Interruption

The Company reserves the right to modify, suspend, or terminate the Service (or any part thereof) at any time without prior notice. The Company shall not be liable for compensation regarding data loss or damages caused by service interruptions, system maintenance, network delays, or third-party API service anomalies.

1.5 Limitation of Liability

(1) Exclusion of Damages: To the maximum extent permitted by applicable law, the Company, its affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages (including, but not limited to, loss of profits, damage to goodwill, business interruption, loss or damage of data, device failure, or procurement costs of substitute services) arising from your use of or inability to use the Service, even if the Company has been advised of the possibility of such damages.

(2) Cap on Aggregate Liability: Except as otherwise mandated by applicable law (such as the Company's intentional misconduct or gross negligence), the Company's total cumulative liability to you—regardless of the legal basis (contract, tort including negligence, strict liability, or otherwise)—shall be capped at the total service fees actually paid by you to the Company for the Service within the three (3) months prior to the incident giving rise to the claim. If you use a free service, the cap shall be limited to NT$1,000.

Where personal data is transferred outside the EEA/UK, the Company ensures adequate safeguards through the European Commission's Standard Contractual Clauses (SCCs) or applicable adequacy decisions. Content Guidelines: You must not use the Service to prompt the AI to generate content involving the sexualization of minors, incitement to violence, hate speech, or other content violating ROC laws. The Company reserves the right to suspend or terminate service upon discovering non-compliant usage, without any obligation for refund or compensation.
